Katy Prairie Legal Fund Appeal and Challenge Grant

The Houston Sierra Club urgently needs your financial support to continue important legal actions to protect the Katy Prairie and the Cypress Creek watershed.

The Houston Group has undertaken a very critical lawsuit challenging construction of Segment E of the Grand Parkway. This suit was filed against the Federal Highway Administration (FHWA) and TXDOT for inadequate environmental analysis.  At this time, we are seeking additional funds to support the progress of the Grand Parkway lawsuit.

A previously filed suit concerns the underestimates of floodplain elevation in the Cypress Creek watershed and was filed against FEMA.  There is the possibility of an additional lawsuit if the Corps of Engineers grants wetland permits in a jurisdictional wetland based upon inaccurate FEMA floodplain maps.  However, there is nothing definite at this time.

Together these suits are extremely significant for regional conservation efforts because they will help define wetland boundaries and mitigation requirements, and influence future development patterns on the Katy Prairie.  We have already realized some success with these actions. Segment E of the Grand Parkway was ruled ineligible for federal stimulus funds because it could not secure wetlands permits within the designated time frame.  And FEMA has acknowledged the underestimates of Cypress Creek floodplain elevations and is scheduled to issue revisions.

The Katy Prairie has long been a conservation priority of the Houston Sierra Club.   In the 1990’s the Houston Group did extensive fundraising in preparation for challenging the Grand Parkway and other detrimental development projects. But these funds have now been depleted and we need to raise additional money.

We have set a goal of $20,000 for new donations toward our legal fund. To support this effort we have received a very generous challenge grant from Brandt Mannchen which will match dollar for dollar all donations toward this goal made by April 1, 2010 up to $10,000.  Please take advantage of this unique opportunity to double the value of your donation!!  Please help us reach our goal!!
